Woman Injured In Restaurant Fall Says Management Won’t Pay Her Medical Bills

After being injured in a fall at Pershing Square Café, a Manhattan woman is pleading with the restaurant’s management to make good on its promise to pay her medical bills.

After slipping on water near the waiter/busboy station at Pershing Square, Fay Shapiro states that the restaurant’s manager Eleazar Carillo promised to pay for the cost of her medical care—but didn’t follow through. She suffered bruised ribs, bruised knees, wrists, and a gash on her head. She said Carillo actually called 911 on the date of the accident on June 27, 2022.

While she had her own insurance, she said she was still left with a $1,900 tab and finally had to pay it out of her own pocket when the medical caregiver threatened to turn her bill over to a collection agency.

Shapiro claims that she called the restaurant repeatedly and, when she eventually got through, was berated by their accountant.

According to a letter Shapiro addressed to the restaurant on January 28th, the accountant told her, “I know your type...Take responsibility for your actions. You fell.” She states that he then hung up on her.

“[The accountant] was rude. He was just horrible, absolutely horrible,” she says.

The management of the restaurant denies that Shapiro was spoken to in that manner.

In her letter, Shapiro asked that the management reimburse her by February 1st and stated that she would “take further action” if they did not. However, she now states she is no longer planning to pursue legal action against the restaurant’s management, and just wants them to make things right.

“Eleazar is a good person,” she says, stressing that she has been a longtime fan of the restaurant and thinks highly of Carillo. “I have no idea [why he hasn’t followed through]. You tell me.”

Carillo states, “The insurance company of the restaurant is taking care of [the bills]...The insurance company should be in touch with her.” He declined to answer further questions.
